The Santa Barbara County Association of Governments (SBCAG) meets concurrently as the  Airport Land Use Commission, the Service Authority for Freeway Emergencies, and the Local Transportation Authority.

Persons may address the SBCAG Board either in-person or through one of the participation options below.

                                             IMPORTANT NOTICE REGARDING PUBLIC PARTICIPATION

The California State Legislature recently passed, and the Governor signed, Assembly Bill 361 (Rivas, 2021), which amends the Government Code to allow Brown Act bodies to continue to meet remotely if certain elements are met. Members of the public may observe and address the Board as shown below including in-person:

Please note the information above is for observation ONLY. If you wish or anticipate a desire to speak during the SBCAG Board of Directors meeting, please select a public participation option listed below.

2. In-person Santa Barbara Location. Persons may address the SBCAG Board in-person on any matter listed on the agenda by completing and delivering to the Clerk a speaker slip before the item is considered. If you attend the Board meeting in-person, you will be required to wear a face covering/mask at all times regardless of vaccination status per County Health Officer Order No. 2021-10.5. Matters not listed on the agenda may be addressed during the public comment item on the agenda. Further information on agenda items can be obtained in the SBCAG Office, 260 North San Antonio Rd., Suite B, Santa Barbara. The SBCAG Board may consider items out of sequence at the discretion of the Chair. Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Board Clerk to all or a majority of the members of the SBCAG Board less than 72 hours prior to that meeting are available for inspection in the SBCAG office and on the Internet at: http://www.sbcag.org/meetings.html.

2. REPORT ON CIRCUMSTANCES OF THE COVID-19 STATE OF EMERGENCY
Recommended action:
A. Receive and file:
    1. An update that the State and County remain under a proclaimed state of emergency related to COVID-19; and
    2. Public Health Recommendation issued September 28, 2021 regarding social distancing.

B. Provide direction to staff about the location of the next meeting.

6. APPROVAL OF CONSENT CALENDAR

A.  APPROVAL OF MINUTES
Recommended Action:
Approve the minutes from the September 16, 2021 Board of Directors meeting.
B.  SBCAG AND COUNTY AGREEMENT TO USE DIGITAL SIGNATURES
Recommended Action:
Approve, ratify, and authorize the Chair to execute an Agreement with the County of Santa Barbara to authorize the use of electronic signatures for a period of five years from June 1, 2021 to June 30, 2026
 C.  OWP AND BUDGET AMENDMENT #2
Recommended Action:
1.  Adopt Resolution 21-33 (Attachment A) amending the FY 2021-22 Overall Work Program (OWP) and Budget (Amendment #2) to reflect actual funding levels for Senate Bill 1 (SB1) formula funding awarded and to correctly reflect FTA 5304 funding as Federal not State.

2.  Approve and authorize the Executive Director, Marjie Kirn, to execute this amendment to the OWP and Budget.

 D.  CHARGE READY TRANSPORT AGREEMENT
Recommended Action:
1.  Approve and authorize the Executive Director to execute an agreement with Southern California Edison (SCE) to construct electrical upgrades at the SBCAG Regional Transit Facility under SCE’s Charge Ready Transport program with a commitment to maintain the equipment for 10 years, upon review and approval by legal counsel.

2.  Approve and authorize the Executive Director to execute any required lease or easement agreement(s) with SCE to allow for access to SBCAG property at 6416 Hollister Avenue in Goleta, to construct, install, and maintain SCE-owned equipment, upon review and approval by legal counsel.
 E.  MEASURE A MAINTENANCE OF EFFORT AND ALTERNATIVE TRANSPORTATION REQUIREMENTS FOR FY 21-22
Recommended Action:
Approve Measure A Maintenance of Effort expenditure requirements for FY 2021-22.
 F.  SANTA BARBARA COUNTY TRANSIT ADVISORY COMMITTEE (SBCTAC) MEMBERSHIP APPOINTMENTS
Recommended Action:
Appoint Hillary Blackerby, Gamaliel Anguiano, Richard Fernbaugh, and Matt van der Linden to new three-year SBCTAC membership terms.
 G.  MEASURE A SOUTH COAST SAFE ROUTES TO SCHOOL
Recommended Action:
Approve the guidelines for Cycle 5 of the Measure A South Coast Safe Routes to School, Regional Bicycle and Pedestrian Program and announce a call for projects.

 H.  AMENDMENT #1 TO SBCAG CASA NUEVA LEASE AGREEEMENT
Recommended Action:
Approve and authorize the Chair to execute a First Amendment to the Lease Agreement between the County of Santa Barbara and the Santa Barbara County Association of Governments for its office located at 260 N San Antonio Road., Suite B, Santa Barbara, known as Casa Nueva, to reduce the amount of leased space resulting in an approximate annual savings of $6,000 in rent without a change to the term ending in 2033.

Recommended Action:
Review and adopt the State Route 154 Safety Committee Bylaws.

7. COVID-19 VACCINATION AND TESTING POLICY
Recommended Action:
A.   Adopt a COVID-19 Vaccination and Testing Policy for all SBCAG workers; and

B.  Authorize the Executive Director to take any necessary administrative actions to execute the Board’s direction.

8. BROADBAND
Recommended Action:
A.  Direct staff to present an item to each of the member jurisdictions requesting their participation and financial contribution to develop a Broadband Strategic Plan.

B.  Recommend a methodology to divide the costs among the jurisdictions.
9. DRAFT 2022 REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM
Recommended Action:
A. Review and comment on the 2022 Draft Regional Transportation Improvement Program (RTIP) programming proposal for submittal to the California Transportation Commission (CTC).

B. Provide a recommendation on programming of funding for Highway 166/Highway 1 project in Guadalupe.

10. CLEAN AIR EXPRESS OPERATING CONTRACT
Recommended Action:
A.  Approve and authorize the Chair to execute the Agreement with American Star Trailways for Clean Air Express operations and maintenance for the period October 30, 2021 to June 30, 2025 for an amount not to exceed $5,350,000.

B.  Approve and authorize the Executive Director to make route changes pursuant to Agreement section VII “Route Changes”.

C.  Approve and authorize the Executive Director to make immaterial amendments in accordance with Agreement section XLIV “Immaterial Amendments”.

Board Members and Alternates are invited to provide updates on the activities in their districts/cities.
12.EXECUTIVE DIRECTOR’S REPORT General Update
The Executive Director will report on activities and achievements of SBCAG staff, SBCAG job openings, upcoming events of interest to the Board of Directors and the public, and general status of SBCAG major projects.
13. CALTRANS DISTRICT DIRECTOR’S REPORT General Update
The District Director will report on Caltrans projects and repairs throughout the state, including Caltrans staff, projects and repairs in Santa Barbara County such as state highways, intersections and bridges, and provide any available updates on Highway 101.
