The Santa Barbara County Association of Governments (SBCAG) meets concurrently as the  Airport Land Use Commission, the Service Authority for Freeway Emergencies, and the Local Transportation Authority.

                                               IMPORTANT NOTICE REGARDING PUBLIC PARTICIPATION

 Based on guidance from the California Department of Public Health and the California Governor's Stay at Home Executive Order    N-33-20, issued on March 19, 2020, to protect the health and well-being of all Californian’s and to establish consistency across the   state in order to slow the spread of COVID-19, SBCAG Board of Directors meetings will temporarily no longer provide in-person participation.
 
Santa Barbara County Association of Governments established alternative methods of participation for the advisory committees, pursuant to the California Governor’s Executive Order N-29-20, issued on March 17, 2020, which states:

Providing an opportunity to“observe and address the meeting telephonically or otherwise electronically,” alone, meets the participation requirement; and
 “Such a body need not make available any physical location from which members of the public may observe the meeting and offer public comment.”

The following alternative methods of participation are available to the public: 

1.  Observe the SBCAG Board meeting Live: you may observe the live stream of the SBCAG Board of Directors meeting in the following ways:
Televised on local cable channel 20; or

Please note the information above is for observation ONLY. If you wish or anticipate a desire to speak during the SBCAG Board of Directors meeting, please select a public participation option listed below.

2.  Public Participation: if you wish to make a general public comment or to comment on a specific agenda item, the following methods are available:

Submit comments via email to info@sbcag.org no later than 5:00 p.m. on Wednesday, September 16, 2020, or through mail to SBCAG at 260 North San Antonio Road, Suite B, Santa Barbara, CA 93110 to be received no later than 5:00 p.m. on Wednesday, September 16, 2020. Your comment will be placed into the record and distributed appropriately.

Read into the record at the meeting. Submit comments of 250 words, or less, via email to info@sbcag.org prior to 5:00 p.m. on Wednesday, September 16, 2020, or through mail to SBCAG at 260 North San Antonio Road, Suite B, Santa Barbara, CA 93110 to be received no later than 5:00 p.m. on Wednesday, September 16, 2020. Please state in your email, or mail, that you would like this "read into the record." Every effort will be made to read your comment into the record, but some comments may not be read due to time limitations. 4. APPROVAL OF CONSENT CALENDAR
Approve by roll call vote on one motion:
A.  APPROVAL OF MINUTES
Recommended Action:
Approve the minutes from the August 20, 2020 Board of Directors meeting.
B.  HIGHWAY 101: MONTECITO (4D) AND HIGWAY 101: SANTA BARBARA (4E)
Recommended Action:
Adopt Resolution 20-22, to supersede and replace Resolution 20-17, authorizing the Executive Director to execute purchase agreements and certificates of acceptance for noise easements with the property owners, whose property has been identified as a “severe” receptor for noise generated from being in the proximity of Highway 101. Per Caltrans’ Agreement 05-0347, SBCAG is the implementing agency for right of way which includes land acquisitions. Total compensation for these agreements in aggregate shall not exceed $200,000. Final agreements to be reviewed and approved by legal counsel.
 C.  FY 2020-21 OVERALL WORK PROGRAM (OWP) BUDGET AMENDMENT #1
Recommended Action:
1. Adopt Resolution 20-21 (Attachment A) amending the FY 2020-21 Overall Work Program (OWP) and Budget (Amendment #1) to reflect FY 2019-20 carryover balances which are certified by the State, to add appropriations for consulting services, reflect unanticipated governmental revenues, to incorporate the recalculated indirect rate, and to shift staffing resources to reflect actual work effort.
2. Approve and authorize the Executive Director, Marjie Kirn, to execute this amendment to the OWP and Budget.

 D.  PROFESSIONAL SERVICES CONTRACT FOR TRANSPORTATION INFRASTRUCTURE FINANCE AND INNOVATION ACT APPLICATION
Recommended Action:
Approve and authorize the Chair to execute the Agreement for Services of Independent Contractor KNN Public Finance for financial advisory services related to applying for and securing a loan through the Federal Transportation Infrastructure Finance and Innovation Act with a period of performance of September 17, 2020 through December 31, 2021 for an amount not to exceed $100,000.

 E.  STATE OF GOOD REPAIR PROGRAM PROJECT LIST APPROVAL
Recommended Action:
Adopt Resolution 20-20 approving the Fiscal Year 20/21 State of Good Repair project list for submittal to the California Department of Transportation.
 
 F.  CARES ACT FTA SECTION 5311 PROGRAM OF PROJECTS AND SBCAG
APPLICATION APPROVAL

Recommended Action:
1. Adopt Resolution 20-19 (Attachment B) approving the submittal for CARES Act Federal Transit Administration (FTA) Section 5311 non-urbanized area transit funds in Santa Barbara County.

2. Approve and authorize the Executive Director, or designee, to submit and sign and additional documents such as certificates and assurances to accept CARES Act FTA Section 5311 fund allocations.
 G.  MEASURE A NORTH COUNTY SAFE ROUTES TO SCHOOL, BICYCLE AND PEDESTRIAN PROGRAM AMENDMENT
Recommended Action:
Adopt a program amendment to the Cycle 3 of the Measure A North County Safe Routes to School and Bicycle Program.
 H.  MEASURE A MAINTENANCE OF EFFORT AND ALTERNATIVE TRANSPORTATION REQUIREMENTS FOR FY 20-21
Recommended Action:
Approve Measure A Maintenance of Effort expenditure requirements for FY 2020-21.
 I.  HIGHWAY 101: SUMMERLAND (SEGMENT 4C)
Recommended Action:
Approve and authorize the Chair to execute Amendment No. 2 to the Cooperative Agreement (05-0355) with Caltrans for the construction phase of the Highway 101: Carpinteria to Santa Barbara Project - Segment 4C to decrease the total amount by $533,000, for a revised total of $132,071,000, which includes an additional contribution of $1,311 from Measure A. The Board must approve additional contributions of Measure A funds for this Segment, if required.

 J.  REGIONAL EARLY ACTION PLANNING GRANT PROGRAM
Recommended Action:
Adopt Resolution 20-18 to authorize the SBCAG Executive Director to approve applications and to execute Memoranda of Understanding (MOUs) with local municipal and county jurisdictions, and the Association of Monterey Bay Area Governments, in order to approve disbursement of Regional Early Action Grant funding to local jurisdictions, in accordance with the Board’s suballocation approved on June 18, 2020, and upon review and concurrence with legal counsel.

2021 UNMET TRANSIT NEEDS
Recommended Action:
A.  Direct SBCAG staff to carry out the 2021 Unmet Transit Needs Process consistent with the expectation that no associated Transportation Development Act (TDA) funding will be allocated for non-transit purposes, such as for streets and roads, OR

B. Direct SBCAG staff to carry out the 2021 Unmet Transit Needs Process consistent with the expectation that TDA funding may be allocated for non-transit purposes, such as for streets and roads.
6. SANTA YNEZ RIVER TRAIL ALIGNMENT STUDY

7.ONE MINUTE REPORTS
Board Members and Alternates are invited to provide updates on the activities in their districts/cities.
8.EXECUTIVE DIRECTOR’S REPORT General Update
The Executive Director will report on activities and achievements of SBCAG staff, SBCAG job openings, upcoming events of interest to the Board of Directors and the public, and general status of SBCAG major projects.
9. CALTRANS DISTRICT DIRECTOR’S REPORT General Update
The District Director will report on Caltrans projects and repairs throughout the state, including Caltrans staff, projects and repairs in Santa Barbara County such as state highways, intersections and bridges, and provide any available updates on Highway 101.
